Terms of service

The agreement between your company and Muster. Written to be read.

These terms are an agreement between Zeller Holdings Inc., the company that makes Muster ("Muster", "we", "us"), and the company that creates a Muster account ("Customer", "you"), and they also apply to each person who uses Muster as part of that company. By creating an account, joining a company's account, or using the Muster app or website (the "Service"), you agree to these terms and to our privacy policy.

1. The Service

Muster is a construction site management app for Android. It includes a time clock with location checks, timesheet approvals, daily logs, tasks and punch lists, safety incident reports, toolbox talks, material requests, and project photos and documents. We may improve and change the Service over time. If we remove a major feature you pay for, we'll tell account owners in advance.

2. Accounts and your company

  • The person who creates the company account is its owner. The owner is responsible for the account, the subscription and who they invite.
  • The owner and managers decide who joins, and what role each person has. Invite codes should only be shared with people who work with or for your company.
  • Each person needs their own login. Keep your password private and tell us if you think your account has been misused.
  • You must be at least 16, and able to agree to these terms on your own or your company's behalf.

3. Free trial

New companies get a 14-day free trial with up to 10 team members and every feature. No card is needed. At the end of the trial, the owner can choose a paid plan to keep using Muster. If no plan is chosen, access pauses for the whole company until one is.

4. Plans and billing

  • Paid plans are monthly subscriptions: Crew ($49/month, up to 10 team members), Pro ($129/month, up to 40) and Business ($299/month, up to 150). Google Play shows the final price in your currency, including any taxes, before you buy.
  • Subscriptions are sold and billed by Google Play, under Google Play's terms. Your subscription renews automatically each month until you cancel.
  • Cancel anytime in Google Play (Payments and subscriptions → Subscriptions). You keep access until the end of the period you've paid for. Refunds are handled by Google Play under its refund policies.
  • Your plan sets the number of active team members. To add people past the limit, upgrade your plan or deactivate members you no longer need.
  • If a payment fails, Google Play may give you a grace period. If the subscription isn't restored, access pauses until it is.
  • If we change our prices, we'll tell account owners in advance, and the change applies from your next billing period in line with Google Play's rules.

5. Your content

You own what you and your team put into Muster: your records, photos and documents ("Your Content"). You give us permission to host, copy, process and display Your Content only as needed to run the Service for you. You're responsible for having the right to upload Your Content, and for getting any notices or consents your team members need, including for location checks at clock-in and clock-out.

6. Acceptable use

Don't use Muster to:

  • break the law or violate anyone's rights, including privacy and employment rights;
  • upload malware, or content that is unlawful, harassing or infringing;
  • try to access other companies' data, get around security or limits, or disrupt the Service;
  • copy, resell or reverse engineer the Service, except where the law allows.

7. Time, location and safety records

Muster helps you keep records. It doesn't replace your own judgment or legal obligations.

  • Time and location. Location checks depend on the phone's GPS and can be inaccurate. Off-site clock events are flagged for review, never blocked. You're responsible for reviewing timesheets and for complying with wage, hour and payroll laws.
  • Safety. Incident reports and toolbox talks support your safety program; they are not a safety program. You remain responsible for site safety, emergency response and any reporting to regulators. In an emergency, call your local emergency number first.

8. Availability and connectivity

We work to keep Muster available and fast, but we can't promise it will be uninterrupted or error-free. The app needs a data connection to save photos, forms and other records. We may carry out maintenance, ideally at quiet times.

9. Ending your account

You can stop using Muster at any time. Cancel your subscription in Google Play, and delete your account in the app under More → Delete account. When the owner deletes their account, the whole company and its data are deleted. See Delete your account.

We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where reasonable, we'll warn you first and give you a chance to fix the problem.

10. Disclaimers

Except as stated in these terms, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent the law allows, Muster won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

12. Indemnity

You'll defend and hold Muster harmless from claims arising from Your Content or your company's use of the Service in breach of these terms or the law.

13. Changes to these terms

We may update these terms. If a change is important, we'll update the date at the top and tell account owners before it takes effect. If you keep using Muster after that, the new terms apply.

14. General

These terms are the whole agreement between us about the Service. If a part of them can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale.
